These Terms of Service (“Terms”) govern your access to and use of the Rosita Ai website, applications, and software-as-a-service platform (collectively, the “Services”). By creating an account, signing in (including via Facebook, Google, or GitHub), or using the Services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Rosita Ai, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you may not use the Services.

2. Eligibility and Account Registration

  • You must be at least 13 years old (or the minimum age required by law in your jurisdiction) to use Rosita Ai.

  • You agree to provide accurate, current, and complete information during registration.

  • You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.

3. Accounts, Social Logins, and Login Dialog

You may create an account using an email/password combination or by signing in with a third-party social login provider, including Facebook, Google, or GitHub (“Social Login Providers”).

When you use a social login, Rosita Ai receives limited profile information authorized by you and permitted by the provider, such as your name, email address, and a unique provider user ID.

Login Dialog Information

When using a social login, the login dialog or consent screen will display the following information:

  • Application Name: Rosita Ai

  • Purpose of Access: To authenticate your identity, create and manage your Rosita Ai account, personalize your experience, and provide access to our Services.

  • Data Typically Requested: Name, email address, and provider user ID.

  • Posting: Rosita Ai does not post content to your social accounts.

  • Policy Links: Links to our Privacy Policy and Data Deletion Instructions are provided or made available.

By continuing with a social login, you authorize Rosita Ai to receive and use this information solely for account authentication and service delivery.

4. Facebook Login App Details

For users who sign in using Facebook Login:

  • App Name: Rosita Ai

  • App Contact Email: info@rosita.ai

  • Permissions Typically Requested: Public profile and email address.

  • Use of Data: Data is used only for authentication, account management, personalization, and service delivery.

  • Data Retention: Data is retained while your account is active and as required for legitimate business or legal purposes.

  • Data Deletion: Upon a verified request, Facebook-provided personal data is deleted within 14 business days, subject to legal retention requirements.

  • Permission Revocation: You may revoke Rosita Ai’s access at any time via your Facebook account settings. Revoking access may prevent future logins via Facebook.

Google and GitHub Login Notes

  • Google Login: Typically provides name and email address for authentication. Access may be revoked in your Google Account settings.

  • GitHub Login: Typically provides basic profile information and email address. Access may be revoked in your GitHub application settings.

5. Permitted Use, Fair Use, and Rate Limits

Rosita Ai provides access to multiple AI-powered tools, including (but not limited to) AI Editor, AI Writer, AI Video, AI Image, AI Article Wizard, AI File Chat, AI Vision, AI Rewriter, AI Chat Image, AI Chat, AI Code, AI YouTube, AI RSS, AI Speech-to-Text, and AI Voiceover.

You agree to use the Services lawfully and in accordance with these Terms. We may enforce fair-use policies, usage caps, rate limits, or other technical controls to ensure platform stability and prevent abuse.

6. User Content and AI Outputs

Your Content:
You retain ownership of content you submit to or generate using Rosita Ai (“User Content”). By using the Services, you grant Rosita Ai a limited, worldwide, non-exclusive license to host, process, and display User Content solely to operate, maintain, and improve the Services.

AI Outputs:
To the maximum extent permitted by law, Rosita Ai assigns to you any rights it may have in AI-generated outputs created for you. You are responsible for reviewing outputs for accuracy, legality, and suitability for your intended use.

You agree not to upload confidential, regulated, or sensitive personal data unless you have the legal right and appropriate safeguards to do so.

7. Plans, Payments, Trials, and Refunds

  • Some features may require payment under a subscription plan.

  • Paid plans are billed in advance and may renew automatically unless canceled.

  • Payments are processed by third-party, PCI-compliant payment processors.

  • Free trials or free tiers may be offered and may be modified or discontinued at any time.

  • Refunds are provided only where required by law or explicitly stated in plan terms.

8. Privacy and Data Deletion

Your use of Rosita Ai is subject to our Privacy Policy, which explains how we collect, use, and protect personal data.

You may request deletion of your data by emailing info@rosita.ai with the subject line “Data Deletion Request.” Verified deletion requests are processed within 14 business days, subject to legal retention obligations.

9. Third-Party Services

The Services may integrate with or link to third-party platforms or services, including social login providers, payment processors, analytics tools, or content sources. Rosita Ai is not responsible for third-party services, which are governed by their own terms and policies.

10. Intellectual Property and DMCA

All Rosita Ai software, branding, trademarks, and platform content are owned by or licensed to Rosita Ai and are protected by applicable intellectual property laws.

If you believe content on the Services infringes your copyright, you may submit a DMCA notice to info@rosita.ai with all required legal information.

11. Prohibited Uses

You may not use the Services to:

  • Engage in illegal activities or violate applicable laws.

  • Infringe intellectual property, privacy, or other rights.

  • Distribute malware, spam, or malicious code.

  • Circumvent security measures, rate limits, or usage controls.

  • Train or develop competing AI models using Rosita Ai outputs without written permission.

  • Violate the terms or policies of Facebook, Google, GitHub, or other third-party services.

12. Disclaimers

The Services and AI outputs are provided “AS IS” and “AS AVAILABLE.” Rosita Ai makes no warranties regarding accuracy, reliability, or fitness for a particular purpose. AI-generated content may be incomplete, incorrect, or inappropriate.

13. Limitation of Liability

To the maximum extent permitted by law, Rosita Ai shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the greater of (a) the amount paid by you in the three months preceding the claim or (b) USD $100.

14. Indemnification

You agree to indemnify and hold harmless Rosita Ai from any claims, damages, liabilities, and expenses arising from your use of the Services, your User Content, or your violation of these Terms or applicable law.

15. Suspension and Termination

Rosita Ai may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, pose a risk to the platform, or if required by law. You may stop using the Services at any time.

16. Beta and Experimental Features

Some features may be offered as beta, preview, or experimental features. These are provided “AS IS” and may be modified or discontinued at any time without notice.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Orange County, California, unless otherwise required by law.

18. Changes to These Terms

We may update these Terms from time to time. The Effective Date above reflects the latest version. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
